Questions before you pay

A living trust is the packet for a home you want kept out of probate. A will names a guardian. Counsel is the attorney introduction.

A revocable living trust or a will?

A will says who receives your property, but it goes through probate, the court process that settles an estate. A revocable living trust holds the assets you move into it during your life. When you die, your successor trustee hands those assets on without probate. You can amend or revoke the trust at any time. The living trust packet includes a pour-over will, so anything you never moved still has a destination.

What does funding the trust mean?

Funding is moving assets into the trust. For the home, that means signing and recording a new deed. For accounts, it means retitling them or adding a payable on death designation. A trust with nothing in it does not keep anything out of probate, which is why the packet comes with a funding list. Read how funding works.

When do I need the counsel desk?

The planner points to counsel when you report a large life policy or a business that may grow, and a net worth band of $5M or more. At that size, tax planning and business succession need a lawyer. The counsel desk introduces you to an attorney. Representation begins only if a lawyer accepts the matter.

Does my state levy an estate tax?

Illinois, New York, Massachusetts, and Washington levy a state estate tax on their state pages. Indiana, Ohio, Florida, and Texas show no current estate tax. Michigan is tied to a federal credit. Open the state page for the statute or revenue link. For deaths in 2026, the IRS basic exclusion amount is $15,000,000. A revocable trust does not remove assets from that estate.
